Appellate Unit Staff Attorney
Children and Family Law Division


The Children and Family Law (CAFL) Division of the Committee for Public Counsel Services, the Massachusetts public defender agency, is seeking three staff attorneys for the CAFL Appellate Unit. The Appellate Unit will be located in Worcester. The CAFL Appellate Unit staff attorneys’ primary responsibility will be representing parents and children in child welfare appellate proceedings. The staff attorneys will also advise CAFL trial staff attorneys on appellate matters and may advise private panel attorneys on matters in which neither the Appellate Unit nor CAFL trial staff attorneys represent another party. They may also participate in other projects related to CAFL appellate and trial practice. The staff attorneys may maintain a very small trial caseload.

Qualifications: Candidates must have the following minimum qualifications:

(1) Demonstrated proficiency in legal research and writing; and (2) At least one of the following:

(a) Current certification for the CAFL appellate panel; or
(b) Primary authorship of two or more appellate briefs; or
(c) A recent appellate clerkship, substantial editing experience for a law journal, or publication of a law journal article.

Requirements: A staff attorney must be committed to serving a culturally diverse, low income population and must be eligible to practice law in Massachusetts, either as a member of the Massachusetts bar, as a law school graduate under Supreme Judicial Court Rule 3:03, or as an attorney licensed in another jurisdiction who is covered by Supreme Judicial Court Rule 3:04. Priority will be given to attorneys who are currently certified to accept CAFL appellate assignments.

All staff attorney positions require travel. Access to reliable transportation throughout the state is necessary. Foreign language skills are desirable.

Salary: Salary is commensurate with experience.

Senior Attorney


Summary:

The Senior Attorney, U.S. Tower is responsible for providing legal support to the U.S. Tower division including but not limited to drafting and negotiation complex asset purchase agreements, real estate, construction and build to suit contracts with customers, landlords and vendors while collaborating with the Senior Counsel and members of senior management. The incumbent works closely with Site Leasing Management, Collocation Project Management, Legal Operations, external customers and customer’s legal counsel to negotiate and implement agreements that are within American Tower’s acceptable business risk and operational parameters and to work within American Tower’s business groups to effectively implement agreements. This position requires excellent drafting and negotiating skills, the ability to exercise sound business judgment and the ability to work autonomously in a time-sensitive environment.


Essential Functions:

• Draft a wide range of complex contracts and documents including but not limited to construction services contracts, merger and acquisition agreements, master lease agreements and build to suit agreements.
• Participate in complex negotiations with customers and customers’ counsel from commencement through deal closure and post-closure follow up and operational implementation.
• Serves as an escalation point for U.S. Tower regarding complex legal issues that may arise.
• Identify and address existing legal issues; anticipate and safeguard against future legal and business issues.
• Conduct substantive legal analysis on real estate issues related to American Tower’s tower, rooftop and DAS portfolios.
• Research and submit legal opinions concerning real estate and telecommunications operations including contracting, government regulation, zoning compliance and other issues.
• Provide legal research, analysis and advice to all levels of management in various departments on business decisions related to real estate investments and contractual risks.
• Keep informed of new laws, regulations and trends affecting the organization, and assists with development of policies, training and educational materials.
• May assist in due diligence examinations in connection with company acquisitions.

Education and Experience:

• Juris Doctorate degree required
• License to practice law in at least one state required
• At least 7 years experience in a law firm or in-house legal role required
• Prior tower industry or carrier experience preferred and prior real estate experience required


Environment:

100% performed in climate-controlled internal office environment working under normal office conditions. Approximately 20% travel will be required in support of the position’s responsibilities.

Director of Mental Health Litigation

The Committee for Public Counsel Services (CPCS) is the Massachusetts state agency that provides legal representation to indigent persons in criminal and civil matters in which there is a right to counsel under the state or federal Constitution, state statutes, or case law. The agency provides representation in criminal, delinquency, youthful offender, child welfare, mental health, sexually dangerous person, and sex offender registry cases, as well as in appeals and collateral proceedings related to these matters.

CPCS seeks a highly experienced attorney to serve as Director of the Mental Health Litigation Division.

The Mental Health Litigation Division (MHLD) provides trial and appellate representation to indigent persons against whom are filed petitions seeking commitment to public or private psychiatric facilities or petitions seeking surrogate decision-making authority (e.g., guardianship or authorization to administer or terminate "extraordinary" treatment modalities). In commitment proceedings, representation is provided either by MHLD staff attorneys or by private attorneys certified by MHLD to accept such assignments. In guardianship proceedings, virtually all representation is provided by MHLD-certified private attorneys.

The Mental Health Litigation Division also trains, and is available to assist, criminal defense attorneys in respect to mental health issues that arise in the criminal justice context (e.g., competency to stand trial, criminal responsibility).

The Director of Mental Health Litigation reports to the Chief Counsel and is a member of the CPCS senior management team, which develops and implements agency fiscal, operational, human resource, and legislative policies. The Director also

• Supervises all staff within and manages all aspects of the Division’s operations;
• Supervises the certification and training of and representation afforded clients by private attorneys in mental health proceedings in all courts of the Commonwealth of Massachusetts;
• Assists, as necessary, CPCS’s Audit & Oversight Department in its review of billings in mental health cases; and
• Regularly consults with judges, attorneys, agencies, clients, clients’ family-members, and others in respect to mental health legal matters.

Candidates for the Director of Mental Health Litigation:

• Must be a member in good standing of the Massachusetts bar, or be licensed in another jurisdiction and eligible to practice in Massachusetts under Supreme Judicial Court Rule 3:04.
• Must have at least ten (10) years of litigation experience, a substantial portion of which must be in the practice of mental health law;
• Must demonstrate a commitment to the protection of the rights of persons with disabilities or other vulnerabilities;
• Must have significant management experience, including supervision of legal and support staff;
• Must possess strong leadership qualities, and superior analytical, interpersonal, communication, negotiation, and decision-making skills; and
• Familiarity with Massachusetts Department of Mental Health regulations, procedures and practices, and with Massachusetts criminal justice practice is strongly preferred.

Salary: $104,000 – $117,000 commensurate with experience.

Environmental Counsel
